These Terms of Service (“Terms”) govern your use of our online e-learning course platform, including our website (the “Site”), mobile applications (the “App”), and related services (collectively, the “Services”). By accessing or using our Services, you agree to comply with and be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not use our Services.

2. Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you meet this age requirement.

3. Account Registration

To access certain features of our Services, you must register for an account. You agree to provide accurate and complete information during the registration process and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Use of Services

(a) License: Equity Builders Group LLC grants you a limited, non-exclusive, non-transferable, and revocable license to access and use our Services for personal, non-commercial purposes.

By submitting User Content, you grant Equity Builders Group LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Services.

(b) Company Content: All content provided by Equity Builders Group LLC, including text, graphics, images, videos, and software, is owned by or licensed to Equity Builders Group LLC and is protected by intellectual property laws. All course materials and video content are copyrighted by Equity Builders Group LLC and cannot be reused or reproduced without our permission. You may not post or share our content on third-party sites. You may not use Company Content without our prior written permission.

6. Payments and Subscriptions

(a) Subscription Memberships: Our Services may include subscription memberships with different tiers. Each tier may offer different features and benefits, as described on our Site and App.

(b) Payments: You agree to pay all applicable fees in connection with your use of the Services. Subscription fees are billed in advance on a recurring basis and are non-refundable. We do not provide any pro-rated refunds for subscription days that are unused.

(c) Pricing: The price for courses and membership subscriptions may differ if purchased through the website or inside the mobile app. Please refer to the specific pricing details provided at the time of purchase.

(d) Cancellation: You may cancel your subscription at any time through your account settings. Your cancellation will take effect at the end of the current billing cycle. You will not receive a refund for any unused portion of the subscription period.

7. Third-Party Links

Our Services may contain links to third-party websites or services that are not owned or controlled by Equity Builders Group LLC. We are not responsible for the content, privacy policies, or practices of any third-party websites or services.

8. Disclaimer of Warranties

The Services are provided on an “as-is” and “as available” basis. Equity Builders Group LLC makes no warranties, express or implied, regarding the Services, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and title.

9. Limitation of Liability

To the fullest extent permitted by law, Equity Builders Group LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Services; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Services; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services by any third party; or (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Services.

10. Indemnification

You agree to indemnify, defend, and hold harmless Equity Builders Group LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of and access to the Services; (b) your violation of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right; or (d) any claim that your User Content caused damage to a third party. This indemnification obligation will survive the termination of these Terms and your use of the Services.

11. Termination

(a) By You: You may terminate your account at any time by contacting us at support@equitybuildersgroup.com. Upon termination of your account, you will no longer have access to the Services.

(b) By Us: We may suspend or terminate your account or your access to the Services at any time, for any reason, and without notice. We will not be liable to you or any third party for any termination of your access to the Services.

12. Governing Law

These Terms and any disputes related to them or the Services will be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the state and federal courts located in Texas for the purpose of litigating all such claims or disputes.

13. Changes to Terms

We may modify these Terms at any time in our sole discretion. If we make changes to these Terms, we will provide notice of such changes, such as by sending an email notification, providing notice through the Services, or updating the “Last Updated” date at the top of these Terms. Your continued use of the Services following the posting of changes constitutes your acceptance of such changes.

14. Miscellaneous

(a) Entire Agreement: These Terms constitute the entire agreement between you and Equity Builders Group LLC regarding the use of the Services and supersede any prior agreements between you and Equity Builders Group LLC relating to your use of the Services.

(b) Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions of these Terms will remain in full force and effect.

(c) Waiver: No waiver of any term of these Terms will be deemed a further or continuing waiver of such term or any other term, and Equity Builders Group LLC’s failure to assert any right or provision under these Terms will not constitute a waiver of such right or provision.

Privacy Policy

Who we are

Equity Builders Group LLC is a new construction and builder consultant. We educate emerging developers and builders on the process of planning and developing residential real estate from the ground up. We will also facilitate the financing and construction of new construction projects on an as needed basis.

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

Embedded content from other websites

Who we share your data with

If you request a password reset, your IP address will be included in the reset email.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.
